Goa mining ban: CM Parrikar takes on Supreme Court;Mar 17, 2013 Panaji: Goa Chief Minister Manohar Parrikar, taking on the Supreme Court, has said it was not adhering to the judicial doctrine of "justice delayed is justice denied" when it came to Goa. "How can the Supreme Court stop a major activity for six months, when justice delayed is justice denied," Parrikar asked, while speaking to a gathering of top industrialists at a function Saturday to mark the annual day of the Confederation of Indian Industry (CII). The petition followed closely on the heels of a finding of a judicial commission, led by Justice M.B. Shah, which exposed a Rs.35,000 crore illegal mining scam in Goa. Responding to the PIL, the Goa government last month told the apex court through an affidavit that the findings of the Shah Commission and the Supreme Court's empowered committee were incorrect. The affidavit also requested the prompt resumption of mining in Goa, claiming that the state's economy was floundering because of the ban on mining.

While hearing a case related to the Goa mining scam, the Supreme Court has taken a major decision, the court has canceled all the 88 mining leases in the state. In such a case, mining will be done only from these mines till March 15. A Bench headed by Justice Madan B. Lokur, according to the order, will now allot the quarries under the new policy. BACKGROUND: In September 2012, Goa went the Karnataka way. First, the Goa government, and subsequently, the Supreme Court (SC) ordered a ban on iron ore mining operations across the state due to environment and encroachment concerns, bringing to halt the state's annual production of over 40mn tons of iron ore. With mining contributing to 30% of the state's revenues, this ban has hit the state hard. This is the VERY FIRST hard-hitting ground report for which I traveled to the dusty mines and government offices across Goa, to bring to light the implications of the issue on the mining industry. STORY: The Central Empowered Committee has recently submitted its report on illegal mining in Goa to the SC and it doesn't contain much good news for the industry. In fact, with the resumption of operation nowhere in sight, the state's mining industry is reaching breaking point. (Insert: Shot of Sesa Goa's mine) Three months ago this mine by Sesa Goa was one of Goa's busiest mines. Every year 4.5 million (mn) tons of iron ore was mined here, and this placed was abuzz with 1500 employees who worked here every day. But now, with the ban on iron ore mining imposed in Goa since September this year, there's only a deafening silence. Sesa Goa is not alone. Mining has stopped in all 90 working mines across Goa following the state's and the Supreme Court's orders, consequently bringing to halt the state's annual production of 40mn tons. Further, the SC-appointed Central Empowered Committee's (CEC) recent recommendation that mining should not resume in 42 of the state's mines because of environment and encroachment concerns is only making matters worse for the ailing industry. So is the CEC's insistence that the Reclamation and Rehabilitation Plan be implemented by companies before resuming mining. Ambar Timblo, MD, Fomento Mines which is one of the large mining companies in Goa says, "From end of May-June of every year till September mining is shut down in Goa because of the monsoon. So the suspension came at a very difficult time because it was a restarting of the season." The situation is grim especially for Sesa Goa, which mines around 14mn tons annually, a third of Goa's total production. Its production in the first half of this fiscal has dropped by 32% from 5.5mn tons last fiscal to 3.7mn tons this fiscal, prompting PK Mukherjee, MD, Sesa Goa to share, "If it is partly shut, partly open then there is question of quantification. There's nothing to be quantified. Everything is shut. Our mining revenue is zero." The ban has also set off a Rs 500cr shortfall in the state's revenues this fiscal, cutting the state off revenues of Rs 1250cr and the central government off taxes of Rs 6500cr. But the Goa government seems more concerned about the unemployment arising out of this ban and is working on an action plan to scrutinize all mining leases. Manohar Parikkar, Chief Minister, Goa is seeking time. He says, "It is the constitutional right of the elected government to govern. So please allow me to govern. Allow me to do the things to clean up the matter because I have been voted for that. I'm accountable to the people." Principal Secretary of the Government of Goa, RK Verma is aware of the challenges that loom ahead, "A large number of families are dependent on mining. Now state government cannot suddenly find jobs for them in one day." Miners at their end are hoping for some relief when the Supreme Court hears their case next month. CEC has recommended the implementation of the Reclamation & Rehabilitation plan before allowing miners to start mining operations in Goa. But given that this process would take over a year to complete, miners intend to appeal to the SC to allow mining to resume, while simultaneously bringing in measures to keep mining irregularities at bay.

The Supreme Court on Monday dismissed a public interest litigation petition seeking the declaration of the Indus Waters Treaty between India and Pakistan as illegal and unconstitutional. “This treaty is of 1960 and this treaty has held good for more than half a century,” a Bench headed by Chief Justice J S Khehar said while dismissing the petition filed by lawyer M L Sharma in his personal capacity. The Bench, also comprising Justices D Y Chandrachud and S K Kaul, however, made it clear that the order dismissing the petition “does not put any impairment on anybody”. The clarification came when Mr. Sharma said that the dismissal of the plea should not put any restriction in the way of the government if it wants to review the pact. During the brief hearing, it was argued that the pact was not a treaty at all, as the same was not signed in the name of the President of India. “It was a tripartite agreement between three leaders and void ab initio (illegal at the outset) and hence cannot be acted upon,” the lawyer said. The court said that it had perused the entire petition and does not wish to agree with it. The agreement was executed on September 19, 1960 between India, Pakistan and the International Bank for Reconstruction and Development or the World Bank. Besides Nehru, then Pakistan President Mohammad Ayub Khan and W A B Iliff for the World Bank were its signatories. Last year, the apex court refused to grant an urgent hearing on the PIL plea, saying there was no urgency in the matter, while asking Mr. Sharma to “keep politics aside”. Mr. Sharma, in his plea, had referred to Article 77 of the Constitution and said it mandated that all executive action of the government shall be expressed to be taken in the name of the President. However, in the case of the 1960 treaty, it was signed by then Nehru and “nowhere it is declared that the said agreement/treaty has been signed in the name of the President of India”, the plea said. “According to the Ministry of External Affairs documents, nowhere disclosed further that the said agreement has been signed by the Jawaharlal Nehru for the President of India...,” it said. “According to the impugned agreement 80 per cent water goes to Pakistan which is a serious injury to the fundamental right of the citizens of India coupled with further financial and natural injuries to national interest,” he said. PI Harish Madkaikar of Maina Curtorim Police station failed to arrest 6 culprits that stoned my bungalow on the night of 6th April, 2015 in retaliation of the goal posts, despite giving them the cctv footage and identifying 2 of the culprits as employees working in a bakery owned by one Isaac Travasso and George Travasso of Nessai. The bakery is attached to their house. On the contrary,s PI Harish Madkaikar and Dy. S.P. Mohan Naik are very active in registering false and fabricated FIRs against me under SC/ST Acts every time my bungalow is being stoned. But Harish Madkaikar has no spine to register FIR against local MLA Benjamin Silva for being an abettor in the crime for it is he who instigated the anti socials on 6th April itself through local television channels that “Demolition of Goal posts is not the final solution” and soon after it was aired at 9.00 p.m.my bungalow was stoned and window panes were broken by the 6 culprits who came on2 bikes with quarry stones in their hands. Even after the demolition of the goal posts, PI Harish Madkaikar and Dy. S.P. Mohan granted permission on 7th April, 2015 to “Dangerous Boys of Nessai” whose self proclaimed president is one habitual offender, Kenthony Fernandes alias Shanu alias Shanus to use loud speaker system during the football tournament to be played on 11th and 12th April, but Dy. Collector, Mr Umakant Korkanvkar rejected the permission as he must have realized the trouble makers. Both PI Harish Madkarkar and Mohan Naik were trying to mislead the State Police Complaints Authority that the permission was given to play on Nessai Football Ground and not on Open Spaces but I soon brought to the notice of SPCA during hearing that there is no Football Ground at Nessai and people in Goa would know this. Anti social elements with the blessings of the Village Panchayat, politicians, police and bureaucrats were forcibly misusing the said private open spaces thinking that only one person is fighting the court battle and that he would not succeed in removing the goal posts. During the next hearing on 22nd Sept. 2015, the said police officers again tried to mislead the State Police Complaints Authority that there the permission was given at Nessai Football Ground, opposite Sun Shine Bar and restaurant and not in open space of Sonum township. There is no football ground opp. SunShine Bar and Restaurant at Nessai but there is a big plot about 84,000 sq.mtrs protected with barbed wires all around no goal posts are erected on it and no any sports activities are going on this big property which is belonging to a private party. The application given by Kenthony Fernandes of Dangerous boys of Nessai and the permission given by the said two corrupt police officers does not say the Football Ground is Opposite Sun Shine Bar and Restaurant and there does not exist any football ground. In this regard, I have complained in writing to the Director General of Police (TN Mohan), Acting Chief Secretary (Shri Srivastava) and the CM and had personally met all of them in April in this respect. But no action has been taken to arrest the 6 culprits until today and to sack the police. Last week, I was shocked to receive a reply under RTI Act from SDPO Mr.Dhinraj Govekar, of Margao that one Isaac Travasso and George Travasso had applied for anticipatory bail but was rejected by the court and they have been arrested and released on bail. However, the reply further says that 6 culprits that stoned my bungalow on 6th April could not be arrested because address is not known. In this regard, it is now very clear that the palms of the PI Harish Madkaikar and Dy. S.P. Mohan Naik are greased or perhaps dirty and corrupt politicians interfered. I say this because my complaint dated 7th April,2015 clearly states that 2 of the 6 culprits identified on cctv footage are working in the bakery of Isaac Travasso and George Travasso of Nessai and this bakery is attached to their house. In the above video, Benjamin Silva, local MLA of Velim constituency portrays his innocence in contrast to my statement. He should know that 100 persons false testimony is not above the law. The order of the courts and the High Court of Bombay at Goa should be respected. If the High Court order is wrong, why the opponents did not approach the highest court, which is the Supreme Court of India with their appeal? The local MLA, first of all, should know that the private Open Spaces reserved are for the benefits of the residents (owners of sub-divided plots of Sonum Township) only and not for the entire village, professional football clubs affiliated to Goa Football Association and other clubs in Goa. Goa government has requested senior Supreme Court lawyer and former Solicitor General of India Harish Salve to provide advice on the mining ban orders by the Supreme Court. The Cabinet Advisory Committee met on Thursday and discussed the review petition that would be filed by the state in the Apex court. CAC informed that Salve has agreed to advise the state on the mining review petition.

During hearing of a writ petition before the High Court, Goa government stated that the status of the subjected road crossing through Margao city will be decided keeping view that the construction work of Eastern Bypass is in the final stage. Many liquor shops have been closed down in Margao city which come in the radius of 500 mtrs. on this road. A Margao city based businessman approached the High Court, whose bar has been closed following the Supreme Court's order, barring sale of liquor in the radius of 500 mtrs. of State and National Highways. The petitioner businessman pleading to renew his bar licence, brought to the notice of the High Court, its observations made in the PIL writ petition 11 of 2012 about status of a national Highway, in case if a optional bypass becomes operational. As per the practice followed by the National Highway Divisions whenever, new stretches of National Highway are constructed for improving the existing alignments, removal of links, construction of a new bridges, diversion of the existing roads, etc. the old lengths are discarded & old National Highway lands get reverted to the State/Union Territory Government. The Government has announced that the process of granting Environmental Clearance for sustainable sand mining and mining of minor minerals has been decentralized. The Ministry has created District Environment Impact Assessment Authority (DEIAA) for proper monitoring of sand mining. In consultation with the State governments, the Ministry has also prepared guidelines for sustainable sand mining.
Chief Minsiter Manohar Parrikar held another meeting with top Bank officials in a bid to finalise the loan restructuring and financial sops scheme for mining dependent businesses. Parrikar said, the package is taking shape and would be announced in the Assembly session begining July 22. Meanwhile, truckkers under the banner of South Goa Progressive Truck Owners Association held a meeting in Curchorem which was attended by BJP MLAs Subhash Faldesai and Nilesh Cabral. Both Faldesai and Cabral, themselves have interests in the iron ore transportation business and have assured the truckers that they would mediate with the Chief Minister to work out a package for writing off or subsidising their interest burdens against bank loans.

Goa government has contended before the High Court that it is in the favour of setting up a circuit bench of National Green Tribunal in the state. The High Court has directed Goa government and MoEF to file affidavits by Thursday clearing its stand on the matter of shifting Goa related environmental cases from NGT Pune bench to Delhi. Meanwhile, Bar Association has also filed intervention application before the High Court opposing Goa government's move to transfer Goa related environmental cases from NGT Pune bench to Delhi. During the hearing before the High Court on Tuesday, Advocate General Dattaprasad Lawande contended that Goa government is in the favour of setting up a circuit bench of National Green Tribunal in the state and has once made a representation in this regard. Without taking name of Chief Minister Manohar Parrkar, High Court took a dig at his statement that cases were transferred from NGT Pune bench to NGT principle bench at Delhi seeing the convenience. The High Court observed that recent media reports do not suggest that Goa government wants a bench in Goa. The High Court further observed that Out of total cases before NGT Pune, about 40% cases are from the state of Goa Pune has no connectivity problem, from Goa bus, train and flight are frequently available If Pune is not convenient, then how can Delhi be convenient which is much far away The High Court also extended its interim order that no files related with Goa cases will be transferred to Delhi till further order. The High Court has taken suo motu cognizance of the shifting of all Goa related environmental cases from National Green Tribunal, Pune bench to Delhi bench. The High Court has stayed transfer of files from tribunal office at Pune to Delhi till further order. While adjourning the hearing for 5th September, the High Court has issued notice to Union of India. After the matter mentioned by some activists and on the basis of some media reports, the High Court on Monday took suo motu cognizance of the shifting of all Goa related environmental cases from National Green Tribunal, Pune bench to Delhi Bench. The High Court ordered the tribunal to maintain status quo till further order. The High Court also barred the authorities from shifting the case files from Pune bench to Delhi Bench. The High Court appointed senior lawyer Adv. Saresh Lotlikar as Amicus Curiae to assist the court in this matter.
