The DENR chief ordered the confiscation after the mining firm, A3 UNA Corp., failed to produce appropriate documents covering the nickel laterites/saprolite ore waiting for shipment at the company's private pier in Brgy. Bolitoc, Sta. Cruz, Zambales. A3 UNA is a holder of a small-scale mining permit and, as such, is only allowed to extract not more than 50,000 metric tons of nickel ore annually. But considering its stockpile of 200,000 metric tons and another 45,000 metric tons shipped out last month, the firm is highly believed to have engaged in over-extraction and violated the law. Atienza went to Zambales this morning to inspect the "hot" nickel ore. After seeing the "mountain" of minerals ready to be shipped out, he said that, "it is very evident that heavy equipment and trucks were used. It is clear that A3 UNA violated the conditions of its mining permit." He said the kind of mining operations that A3 UNA had engaged in is an example of abuse committed by a small-scale mining permit holder. "We will not tolerate other similar and further abuses," Atienza said. "Compliance with the law ensures beneficial effects of mining to many while abuse of the law is detrimental to the many and benefits only the few. Zambales congressman Tony Diaz, who joined Atienza in the inspection visit, charged that the trucks hauling the nickel ore from the mine site to the shipment point are overloaded and destroy the roads in the area. Sta, Cruz mayor Luisito Marty complained of not having received a single centavo of the town's share from the profits of A3 UNA. Atienza urged local officials, like Marty, to monitor the operations of mining firms and ensure their compliance to environmental laws and their share of proceeds from mining activities. The nickel ore at A3 UNA'S private pier was earlier placed under seizure on February 8 by the DENR pending submission by A3 UNA Corp. of documents such as ore transport permits (OTPs), mining permits, operating agreements or any document that would prove that the said nickel ore was legally sourced. The seizure order partly stemmed from the complaints of four mining companies which alleged that A3 UNA had been mining in their permit areas without their consent, using small-scale mining permits issued by the local government. The complainants were Zambales Chromite Mining Corp. (ZCMC), Eramen Minerals, Inc., Benguet Corp., and Filipinas Mining Corp. (FMC). ZCMC, Eramen and Benguet Corp. have valid and existing Mineral Production Sharing Agreements (MPSAs) in Sta. Cruz issued by the DENR. FMC, on the other hand, has prior right over the area by virtue of a pending MPSA application at the DENR. Section 53 of Republic Act No. 7942 or the Philippine Mining Act of 1995 requires the issuance of an Ore Transport Permit or OTP for the transport of non-processed mineral ores or minerals, the absence of which is considered a prima facie evidence of illegal mining and considered a sufficient cause for the government to confiscate the ores or minerals, including the tools, equipment and conveyance used in the commission of the offense.

In 2010, the farmers of Tubo-tubo North and Tubo-tubo Sur started experiencing overflow of the river flooding their farms... the flood carried fine sand that inundated their farms, This sand more than six inches thick made their farms non-arable. After a couple of years, more farms were inundated. Their experience is similar to the experience of farmers in the nearby barangay, Almasin. However, in Almasin gravel and sand covered their farm lands. This problem was documented by the Concerned Citizens of Sta. Cruz (CCOS) and was presented to the Sangguniang Panlalawigan of Zambales. Investigations were conducted and the complaint was validated by the regional office of the Dept of Agriculture (DA), the provincial DA and the Environment and Natural Resources Office of Zambales. These agencies computed the damages to be a little more than ten million pesos (P10M). This was endorsed by the provincial government to the Mines and Geoscience Bureau Region 3 last June 2013, but until now, the farmers are yet to be compensated. The concrete roads became dirt roads, the rivers were heavily silted killing marine lives, respiratory and skin diseases increased due to the polluter ambient air, farm produce went down, fisher folk's catch declined... the politicians amassed wealth, some people got killed. Not a single mining company was penalized for this environmental and human destruction.

The town of Sta. Cruz, Zambales, Philippines is the rice granary of Zambales. It is also the town of the sweetest mango of the world, the Sweet Elena variety. The home of the two white sand islands and other possible tourist destinations. But this town and its people are now threatened by the open cut mining operations of at least five (5) companies hauling down 8.5 million dry metric tons of nickel and other minerals a year. The fishponds in Sta. Cruz, Zambales earning hundreds of millions of pesos annually and the rivers are now filled with laterites courtesy of the mining companies allowed by the government, local and national to operate... Hundreds of hectares of farmland are now non-arable while thousands of hectares of irrigated prime farmland are in danger of becoming non-arable. The incidence rates of bronchial asthma and other respiratory diseases increased 2 to 3 times. Yet, in spite of the destruction of the people's livelihoods, fishing and farming, destruction of the watershed, rivers, the sea and other bodies of water, destruction of roads, increasing diseases of the people, and massive floods that never happened before submerging almost all the barangays bringing shivers and sleepless nights to the people, the five mining companies are allowed to operate in large scale with impunity...

We left the mountain paradise in 1978 thereafter, my parents migrated to the US. My dad expired at the age of 89 on January 6, 2007, and after a month my mother who was 81 joined her creator. They both died peacefully in their sleep. The loss of our parents has been painful, yet also strangely reaffirming because it has made us ever more aware of the rewards and importance of a family. Acoje is a place over the rainbow called, HOME. These videos were shown on the occasion of their internment at the Sanctuario de San Antonio on June 17, 2007.

The Chinese have done mining and caused a lot of damage in the area but it has since stop due to the order of the government. The water was drinkable when I was younger but I was told that it is no longer possible to drink due to contamination from the mining. Other than that we were able to soak ourselves in the water for a short while which brings back childhood memories.

Nasuspendi ang operasyon ng lahat ng miniro sa mga bayan ng Sta. Cruz at Candelaria lalawigan ng Zambales dahil sa kanilang paglabag sa mga batas at patakaran ng pagmimina.... Sinuspendi ng Mines and Geosciences Bureau ang operasyon ng Benguet Nickel Mineral Inc., Eramen Mineral Inc., Filipinas Mining Company/Lnl Archipelagic Minirals Inc., at Zambales Diversified Minerals Corporation/DMCI mula noong ika 15 ng Hulyo 2014 dahil sira na ang lahat ng ilog ng Sta. Cruz at abot na sa malalim na bahagi ng dagat ang tubig na may dalang lason mula sa mga miniminang bundok ng apat na kumpaniya... Malinaw na grabe na ang perwisyo at hindi na maaayos ang nagawang perwisyo... kaya naniniwala ang Concerned Citizens of Sta. Cruz, Zambales (CCOS) na hindi suspension ang dapat na ginawa ng MGB, dapat ay kanselasyon ng mga MPSA ng apat na miniro.

Its an EMERGENCY situation. A two kilometer river valley filled with 3-4 feet mining debris laced with nickel laterite might produce a killer flood if the situation is not averted. The river valley has a very narrow exit that might close soon. Once closed the fragile rock formation that divides the valley from the lower villages might give way. This rock formation that houses a cave and the underground river where the river valley continues, is cracking. Actually, part of it already crumbled a few years ago destroying the once beautiful Balocbaloc Falls. To AVERT the killer flood, the Mines and Geosciences Bureau and the local government should investigate the situation and institute the necessary action ASAP. If the situation is not corrected, every minute gone is a minute less from the impending deluge. ACT NOW, SAVE Sta. Cruz.
